What is a Lease Plan?
A leasehold document is a legal agreement to describe the extent of of a building (or land) to which a leaseholder has exclusive rights, or shared rights respectively.
A lease plan is a floor plan, drawn to an appropriate scale. Its purpose is to provide a visual representation of the rights explained by the written document.
When is a lease plan required?
When a leashold property is first registered it will be necessary to prepare and submit a lease plan. It will also be required when a leasehold property is sold, providing there is 7 or more years left on the term.
A lease plan will also be required when a lease is extended. Often, leaseholders will have a right to extend their leasehold if they have owned the property for 2 years.
Lastly, a new lease plan will be required when the extent of the demise is altered, such as when an extensions is built or a basement conversion is completed.
Is there a required format?
The Land Registration Act 2002 gives clear guidance that all plans submitted to the Land Registry must meet a required standard. In the case of lease plans this means that:
There must be a detailed floor plan to a larger scale, such as 1:100 or 1:200 as applicable.
Include a location plan at 1:1250
Include a North Point
Be in CAD format
Include colour hatch areas to show the demise and communal areas
It should also be an accurate reflection of the Lease document
How accurate are they?
Unlike a title plan, a lease plan is not based on OS data. Instead this is based on a measured survey by a competent surveyor. A lease plan is also drawn at a much larger scale and as such is more accurate.
