What is a Transfer Plan?

For each and every transaction involving the sale of land, there must be a clean means of identifying the land in question. Often this can be part of a larger title. A transfer plan can help to illustrate which area is being transferred out of a title.

Is there a required format?

Much like a title plan, a land transfer plan must be compliant with a set of rules as directed by Land Registry, known as Land Registry Practice Guide 40. This should be based on Ordnance Survey data and this should be presented to a scale of 1:500 or 1:1250. There should be a North point indicated.

The extent of the land on the current title is to be indicated with a red line. A blue line or a blue hatch can then be used to indicate the area of land to be transferred off the title. It is imperative that the means of identifying the land to be transferred is consistent with the description in the written registration document.

How accurate are they?

The plan is based on Ordnance Survey data which does have the same degree of accuracy as with a title plan. At 1:1250 scale 1mm represents 1.125m.

Adverse possession of unregistered land

Another use for a transfer plan is for adverse possession of unregistered land. In the UK it is possible to claim land under the Land Registration Act 2002 and Limitation Act 1980.

An application would need to be made using form AP1 identifying the title to be amended. A fee would also be payable based on the current land registration fee order
